Alternative Dispute Resolution

Alternative Dispute Resolution (ADR) refers to legal mechanisms used to resolve disputes outside the traditional court system. ADR includes arbitration, mediation, and negotiation, offering time- and cost-effective solutions—particularly in commercial, civil, and family matters. At Azzi Law Firm (ALF), we advise and represent individuals and companies in ADR proceedings, helping them resolve disputes through structured, legally recognized processes.

Arbitration

Arbitration is a binding dispute-resolution process conducted outside court, where the parties agree to submit their dispute to an independent arbitrator (or tribunal) instead of filing litigation. It is widely used for complex matters, especially commercial and financial disputes, due to its flexibility, confidentiality, and procedural efficiency.

Arbitration is one of the principal ADR methods, alongside

  • Mediation: a neutral third party facilitates discussions to help the parties reach an amicable settlement.
  • Expert determination: a typically non-binding process where technical experts assess the dispute and provide conclusions or recommendations.

Arbitration is commonly used in

  • Commercial disputes: conflicts between companies, partners, suppliers, distributors, or other business counterparties.
  • Investment disputes: issues involving investors and states in relation to financial agreements, concessions, or commercial undertakings.
  • Credit and financial obligations: enforcing or restructuring financial commitments and settling debts outside court.

At ALF, we have extensive experience in domestic and international arbitration and represent clients in complex disputes involving private entities, investors, and states.

Mediation

Mediation is a non-adversarial dispute-resolution method in which a neutral mediator assists the parties in reaching a mutually acceptable settlement without the need for a court judgment. Unlike arbitration, mediation is non-binding (unless a settlement agreement is reached and formalized) and allows parties to explore solutions freely and confidentially.

Mediation is widely used in

  • Family matters: disputes relating to divorce, maintenance, child custody, and division of property.
  • Commercial disputes: facilitating agreements between companies, employers and employees, and business partners.
  • Civil and community disputes: helping individuals and organizations resolve conflicts amicably and constructively.

At ALF, we have acted as mediators in a range of complex disputes, helping parties reach constructive, durable solutions without resorting to court proceedings.

Negotiation

Negotiation is a key ADR tool involving a structured dialogue between disputing parties aimed at reaching an agreement acceptable to all sides. It is a core skill in both personal and business disputes, helping parties overcome deadlock and achieve practical compromise.

Negotiation is commonly used in

  • Employment relationships: disputes between employers and employees, including matters involving unions.
  • Real estate transactions: negotiating terms of purchase, sale, and leasing arrangements.
  • Business agreements: resolving disputes concerning contracts, partnerships, and financial obligations.
  • Family settlements and divorce: agreeing on separation terms, maintenance, and child custody arrangements.

At ALF, our legal team is highly skilled in negotiation and works strategically and professionally—even in difficult situations—to achieve efficient resolutions and positive outcomes for our clients.
